A deceased adult’s medical records: what reason should the request explain?

After a death, check your eligibility to request information and explain the reason permitted by the rules.

General information, not an individual diagnosis. Ask a healthcare professional if you are unsure about your situation.

After an adult dies, access to medical information remains subject to rules. Being close to someone does not by itself allow unrestricted access to their whole record.

Service Public lists eligible heirs, a cohabiting partner and a civil partnership partner. Ask the record holder which documents establish your identity and eligibility.

Your request must explain its purpose: establishing the cause of death, defending the deceased person’s memory or asserting a right. Describe your specific need within that framework.

CNIL states that accessible information is limited to what is needed for that purpose. Any objection expressed by the person during their lifetime must also be considered.

Address the request to the healthcare professional or institution holding the information. Identify the relevant stay or care period to help the recipient locate the records.

A refusal must give reasons. Keep your request and the reply so you can seek clarification about the reason or documents required, without assuming automatic access to the full record.
